TERMS & CONDITIONS

Last updated: September 2026

These Terms and Conditions govern the use of the RTKSA website, RTK correction services, NTRIP access, subscriptions, free trials and related services.

By registering for, purchasing, accessing or using an RTKSA service, the customer agrees to these Terms and Conditions.

1. RTKSA Services

RTKSA provides access to Real-Time Kinematic (RTK) GNSS correction services through supported NTRIP connections and related correction infrastructure.

RTKSA may provide customers with usernames, passwords, mountpoints, server details and other connection information required to access the service.

RTKSA does not manufacture or control the GNSS receivers, drones, survey equipment, agricultural equipment, mobile devices, software, mobile networks or other third-party equipment used by customers.

2. Coverage and Availability

Coverage maps, station locations and other coverage information are provided as a guide only.

RTKSA does not guarantee that correction services will be available at every location or at all times.

Service availability may be affected by reference station outages, mobile or internet connectivity, satellite availability, buildings, trees, terrain, atmospheric conditions, interference, maintenance, customer equipment and other circumstances outside RTKSA’s reasonable control.

RTKSA does not guarantee uninterrupted, continuous or error-free service.

3. Accuracy

RTK technology can provide centimetre-level positioning under suitable conditions, but RTKSA does not guarantee any specific positional accuracy.

Accuracy depends on factors including customer equipment, antenna quality, satellite conditions, correction age, distance from reference stations, connectivity, environment and equipment configuration.

Customers are responsible for confirming that a valid RTK FIX has been achieved and for checking the quality of the positioning solution.

A displayed RTK FIX does not itself guarantee that a coordinate or measurement is correct.

4. Critical Measurements

Customers must independently verify measurements where an incorrect position could result in property damage, construction errors, boundary disputes, crop damage, equipment damage, injury, regulatory problems or significant financial loss.

RTKSA must not be used as the sole safety or verification system for critical operations.

5. Equipment Compatibility

Customers are responsible for ensuring their equipment supports the correction format, NTRIP connection and other technical requirements needed to use RTKSA.

RTKSA may assist with setup but cannot guarantee compatibility with every receiver, drone, survey controller, agricultural system, application, firmware version or software platform.

6. NTRIP Credentials

Credentials supplied by RTKSA are intended only for the customer and authorised devices covered by the customer’s subscription.

Customers may not, without written permission from RTKSA:

Share credentials with unrelated third parties;

Publish credentials;

Resell RTKSA access;

Redistribute correction data;

Exceed permitted simultaneous connections;

Attempt to bypass connection limits; or

Provide RTKSA correction services to other parties as their own service.

RTKSA may suspend or terminate access where misuse is detected.

7. Free Trials

RTKSA may offer free or temporary trials for evaluation.

Trials may be limited by duration, devices, connections, coverage or functionality.

Customers should use the trial period to confirm coverage, equipment compatibility and suitability before purchasing a longer subscription.

8. Subscriptions and Payments

RTKSA may offer monthly, annual or other subscription plans.

The price, subscription period and included features will be displayed at the time of purchase.

Where recurring billing is enabled, the customer authorises RTKSA or its payment provider to process recurring payments until the subscription is cancelled.

Failed or overdue payments may result in suspension of service.

RTKSA may change pricing from time to time. New pricing will normally apply from the next renewal period.

9. Cancellation

Customers may cancel their subscription using the cancellation method provided by RTKSA.

Cancellation prevents future renewals.

Where applicable, access may continue until the end of the already-paid subscription period.

10. Refunds

Because RTKSA supplies a digital service that may become available immediately, customers should make use of any available trial before purchasing a longer subscription.

Refund requests will be considered individually.

Refunds may be declined where the service was functioning substantially as described or where the problem resulted from customer hardware, configuration, internet/mobile connectivity or lack of suitable coverage.

Nothing in these terms removes rights a customer may have under applicable South African law.

11. Acceptable Use

RTKSA may be used for legitimate applications including surveying, mapping, GIS, agriculture, construction, drones, machine guidance, navigation and other GNSS-related applications.

Customers remain responsible for complying with all applicable laws, licences, regulations and professional requirements.

12. Surveying and Boundaries

RTKSA provides GNSS correction data and is not responsible for certifying cadastral or legal property boundaries.

RTKSA does not certify property boundaries, beacons, cadastral coordinates, survey diagrams or legal land descriptions.

Where work must legally be performed or certified by a registered professional, the customer remains responsible for obtaining those services.

13. Drones, Agriculture and Machine Control

Customers remain responsible for the safe operation of drones, agricultural equipment, auto-steering systems, machine-control equipment and autonomous or remotely operated equipment.

Operators must monitor their equipment, maintain appropriate safety systems and confirm that positioning information is suitable before relying upon it.

RTKSA is not a safety system.

14. Coordinate Systems

Customers are responsible for ensuring that the correct coordinate system, datum, projection, geoid model, transformation and units are used.

RTKSA is not responsible for errors caused by incorrect coordinate or transformation settings.

15. Coordinate Systems

RTKSA may rely on third-party infrastructure including reference stations, telecommunications providers, hosting providers, software systems and correction networks.

RTKSA cannot guarantee continuous operation of infrastructure outside its reasonable control.

16. Maintenance and Changes

RTKSA may perform maintenance and may change servers, ports, mountpoints, credentials, correction formats, stations or other technical elements of the service where reasonably necessary.

RTKSA will endeavour to minimise disruption but cannot guarantee advance notice of every interruption.

17. Customer Responsibilities

Customers are responsible for:

Correct equipment configuration;

Protecting account credentials;

Confirming RTK FIX status;

Monitoring solution quality and correction age;

Confirming the correct coordinate system;

Independently checking critical measurements;

Maintaining appropriate backup or alternative positioning methods;

Operating equipment safely; and

Complying with applicable laws and professional standards.

18. Limitation of Liability

To the maximum extent permitted by law, RTKSA will not be liable for indirect, consequential, incidental or special loss resulting from the use or inability to use RTKSA services.

This includes loss arising from:

Incorrect coordinates;

Surveying or setting-out errors;

Construction errors;

Boundary errors;

Crop loss;

Equipment or drone damage;

Machine-control errors;

Loss of data;

Loss of production;

Business interruption;

Material wastage; or

Unavailable or inaccurate correction data.

To the extent permitted by law, RTKSA’s total liability relating to the service will not exceed the amount paid by the customer for the affected RTKSA service during the preceding 12 months.

Nothing in these Terms excludes liability that cannot legally be excluded under South African law.

19. Privacy and POPIA

RTKSA processes personal information in accordance with the Protection of Personal Information Act 4 of 2013 (POPIA) and applicable South African privacy law.

Information may be collected for account creation, subscriptions, payments, support, communication, fraud prevention and operation of the service.

Personal information may include names, contact details, company details, billing information, IP addresses, account activity and technical information.

RTKSA will take reasonable measures to protect personal information against unauthorised access, loss, misuse or disclosure.

Information may be shared with service providers such as payment processors, hosting providers, communication providers and technical service providers where reasonably necessary to operate the service.

Customers may request access to or correction of their personal information and may exercise other rights available to them under POPIA.

Further details must be provided in the separate RTKSA Privacy Policy.

20. Communications

RTKSA may send customers service-related communications regarding their account, billing, renewals, security, maintenance and technical changes.

Marketing communications must be handled separately and in accordance with applicable privacy and electronic communications requirements.

21. Intellectual Property

The RTKSA name, branding, website, documentation and original materials remain the property of RTKSA or the relevant rights holder.

Customers may not copy, resell or commercially redistribute RTKSA materials or correction access without permission.

22. Suspension or Termination

RTKSA may suspend or terminate service for non-payment, misuse, unauthorised sharing or resale, excessive connections, unlawful activity, interference with RTKSA systems or material breach of these Terms.

23. Force Majeure

RTKSA will not be responsible for failure or delay caused by events outside its reasonable control, including power failures, internet outages, telecommunications failures, satellite-system problems, GNSS interference, natural disasters, government action, civil unrest or failure of critical third-party infrastructure.

24. Changes to These Terms

RTKSA may update these Terms from time to time.

The latest version will be displayed on the RTKSA website together with the revision date.

25. Governing Law

These Terms are governed by the laws of the Republic of South Africa.

Any dispute will be handled in accordance with applicable South African law.
